Below, please find an exact copy of the letter I sent to the manager of All My Sons. He did not return a single phone call and has avoided all of my follow up attempts. We are currently pursuing legal action. *** August 5, 2007 Eddie Ciular Manager All My Sons Moving & Storage 2 Lawrence Street Ardsley, NY 10502 Dear Mr. Ciular, It would be difficult to imagine a more horrendous moving experience than what your company provided on July 30-31, 2007; late arrivals, the wrong size truck, belongings left outside on the lawn, drivers hopelessly lost, loaders treating belongings like so much trash to be thrown around and banged into walls, surly loaders lying to avoid work and moving at a snail’s pace, precious items not wrapped, and the list goes on. I am forced to write you this letter to memorialize the events surrounding the move, and the widespread damage caused to our possessions. I would have preferred to have spoken with you about these matters over the phone, however I have made five attempts to contact you by phone (July 31, twice on August 1, August 2 and on August 4) and you have not returned a single message. I am thus adding that to the list. The depraved indifference and willful disregard demonstrated by your crew who moved my family on Monday, July 30 from Peekskill was shocking. Per your promise and our call the Saturday prior, your crew was dispatched at 630 am on July 30 but did not arrive at my house until 915 and the only reason why they arrived at my house at 915 is because I had to personally drive throughout the streets of Peekskill to find them as they were unable to follow simple directions to my house. Adding to the early morning frustration of the crew’s extreme lateness was the fact that I had communicated to you days earlier that we were closing on our home at 2:00 pm and we needed to be out of our home by then. You promised me this would not be an issue. This was reinforced when you spoke to my wife at 10:30 on July 30 and again promised that they would be done in plenty of time. Over the next 8 hours, your crew demonstrated nothing but disrespect for our property that they were trusted to handle. A smoke break was taken inside the truck and ash covered my toddler son’s toys. This would have probably continued for another ten minutes had I not begged them to stop As the clock continued to tick away, your crew, working ever so slowly, decided to finally start moving furniture into the truck. The first piece they took was my dresser. After thoroughly damaging my entire staircase walls and hallway leaving 3” holes in the wall, they finally got the item into the truck only after they raised their voices to my wife when she expressed her concern over the damage done. At 11 am, our cleaning crew arrived and they were unable to do we needed as the house still remained mostly full. We had to pay them for work they were unable to accomplish. At 1 pm, my wife and I had to leave the home for the closing and my mother in law came to observe the move. She continued to witness awful treatment by your crew as they mishandled our property and showed no respect for our belongings.. During the closing, my wife and I were on the phone with my mother in law who described a scene of chaos. Members of your crew told her that certain rooms were fully emptied (i.e. office, attic, etc.) when in fact they weren’t. Boxes and furniture were left in rooms that were allegedly completed by your crew, and at one point the crew said that it was “not in their contract” to remove items from the attic. Thankfully my mother in law was diligent in her efforts to ensure that all of our belongings were in fact collected. As 4pm rolled by, news from my mother in law got worse. She told me that your crew started throwing our belongings down the steps and in at least one instance, causing a box to spill open. Furniture items were being roughly dragged into the truck, banging off the floor and walls. Just when it couldn’t get worse, the truck you sent ran out of room. When you came to my house and personally surveyed my property and gave me my move estimate, you assured me that a proper sized truck would be sent. However, what happened next was even more disturbing. When the truck filled, your crew simple left the balance of my belongings on the front law including a 56” television and several furniture items. What if there was a summer shower as is quite typical in July? Then, without a single word to my mother in law, your crew simply left. Around the same time, you and I were on the phone and you informed me that a second truck was on its way. (For the record this was probably the 10th time we spoke that day as I expressed concern all day about the late start and the slowness of the move.) When my wife and I arrived back at our home in Peekskill, I called you yet again to ask where the second truck was. Turns out he was lost too and for a second time in the day, I had to hunt for your driver in the streets of Peekskill. Hours after we officially no longer owed our home, your crew finished the move. Thankfully our buyers were kind, understanding people who accommodated us. They could have easily locked the door with our belongings inside had they wanted to. On Tuesday, July 31, I called you again to express my concern over our “move out” and how I had no confidence in the condition of our property. You told me that you actually fired the crew from the day before and a new crew was sent to move us in. You assured me that everything would be okay. You also graciously told me that you weren’t going to charge me for the fuel for the second truck sent to finish the move. In addition, we would be receiving a discount to be discussed later due to our troubles. As our move in time approached, and passed, I had to once again search the streets of Peekskill for your moving van as they were lost. Once found, they followed me to my house and began unloading the truck. The crew you sent, Claudio, J.R. Jr, Jose, Jemmel and Aneudy were extremely professional and accommodating. As they unloaded our items, to our dismay (and theirs) we found that the first crew had not wrapped many items of furniture, or had wrapped them only in clear plastic film, which not only did not protect them from the abuse of your loading crew, but caused further damage to the finish on those hot days.. As my wife watched one damaged piece after another come off the truck, she was in tears over the damage that had been done to irreplaceable items with great sentimental value. In fact, significant damage was done to dozens of articles of personal property. Massive disrespect and indifference was shown to items such as my wife’s grandmother’s oil paintings that were not even wrapped when thrown into the truck. Another painting, gifted to my wife from her best friend’s mother who passed away from cancer a few months ago, was tossed into the back of the truck with no wrapping or protection and was damaged. In addition to these items: 1. An antique family heirloom, a solid wood dining room table, was gashed and damaged. 2. Another antique family heirloom, a solid wood hutch, was scratched, nicked, missing a knob on one of the drawers, and damaged. 3. Yet another antique family heirloom, a solid wood desk was horribly scratched, nicked and damaged due to the fact that it was only wrapped in plastic. 4. My mattress was soiled, wrapped in only one layer of plastic, and also had a 5 inch gash across the pillow top. Imagine, a 5” gash! How did they do that? This item needs immediate replacement. 5. One dresser from the master bedroom is scratched and chipped. 6. Another dressed from the master bedroom scratched and chipped. 7. My sleigh bed was scratched and chipped. 8. Both bedside tables from the master bedroom are scratched and chipped. 9. My son’s crib was scratched and damaged. 10. My son’s dresser/hutch was scratched and damaged. 11. Several boxes were damaged and the articles inside them were damaged including various dishware. 12. Multiple pictures not wrapped, simply thrown on the truck. 13. Patio furniture scratched. 14. Legs of our couches scratched. We took digital photos of the damage and can send these to you. It is also worth noting that the July 30 crew threw all of the hardware from my bed, son’s dresser/hutch and most concerning of all my son’s crib in one Ziploc bag. Therefore, putting these pieces of furniture back together was challenging to say the least. It is extremely negligent that they did not separate the specific hardware pieces for the specific pieces of furniture to ensure that the pieces are going to be put back together properly. This is a major safety concern, especially in regards to my son’s crib. This is just further evidence of the sloppy work and disrespect that they had for our property. I wanted it noted that no fewer than ten times your unloading crew remarked how shocked they were about the state of our property and the blatant disregard for it shown by the loading crew. The depraved indifference shown by your crew on July 30 violated every level of trust a service provider should provide to their customer. Your crew on July 30 treated my property as if it was trash and could not have shown any less respect if they tried. When I welcomed you to my house, I expected a basic threshold of service from your company. I trusted your company but the subsequent actions by your company and crew caused damage that cannot be repaired. On what was supposed to be a joyous occasion, All My Sons turned it into a nightmare. I expect nothing less than full reimbursement and/or replacement of items damaged and destroyed. Anything less will simply be unacceptable. For starters, I have protested all charges of your company on my credit card, although those amounts will constitute only a fraction of the damages we are owned for repair and replacement.
